A New Haven Superior Court jury found David Britto, 61, guilty October 7 of first-degree sexual assault, first-degree unlawful restraint and third-degree assault, according to an October 9 prosecutor’s release.
The case concerned a July 19, 2018 assault in New Haven. Identifying information about the victim is omitted.
The verdict followed a retrial. A jury initially convicted Britto June 26, 2023, but the Connecticut Appellate Court reversed that conviction in 2025 because he had not been adequately advised of the risks and disadvantages of representing himself, the release says.
Britto had counsel at the retrial, which Judge David L. Zagaja presided over. New Haven police’s Special Victims Unit investigated the case.
Sentencing is scheduled for December 16 in New Haven Superior Court. A scheduled sentencing is not an imposed sentence, and this report does not establish a prison term.
The account is based on the New Haven Judicial District state’s attorney’s announcement. The distinction between the reversed earlier conviction and the new jury verdict is central to the case’s procedural history.
